Agreement to Terms
All users and customers of Dropals services agree to comply with these Terms of Service. The TOS ensures the fair use of Dropals services while respecting the rights of other Internet users. Dropals reserves the right to modify the TOS at any time, effective upon posting to our website or notification. Complaints about TOS violations should be sent to [email protected]. By agreeing to the TOS, you also accept our billing terms. This TOS supersedes any other agreements unless explicitly agreed otherwise in writing by Dropals.
Server Resources (Shared Hosting Plans)
Websites using excessive server resources (CPU, memory, network) must reduce usage or risk shutdown without notice. Users on shared hosting plans should not use more than 75% of their allocated server resources consistently. If usage exceeds this limit, users must upgrade to a business plan to access 100% of the resources.
Scripts that consume large resources, such as bots, proxies, and torrent scripts, are prohibited. Accounts using more than 75% CPU for over 30 minutes must upgrade their plan or move to a VPS or dedicated server. No refunds are issued for accounts terminated due to TOS violations.
No Tolerance Spam Policy
Sending unsolicited or bulk messages (spamming) is strictly prohibited. CAN-SPAM compliant bulk emails are also not allowed. Email forwarders with a failed rate above 1% may result in the suspension of email services until resolved. Accounts involved in spamming face immediate termination without refunds.
Denial of Service Attacks
Participating in DDoS/DoS attacks, including stress testing, is not tolerated. Offending accounts will be suspended or terminated without refunds.
Prohibited Material
The following are prohibited on our servers:
- IRC related items
- Proxy scripts
- VPN scripts
- Nulled or pirated software
- Image/file hosting scripts
- Rapid Leech scripts
- PTC sites
- Spam scripts
- Hacking sites
- Illegal activity sites
- Bitcoin miners
- Auto-blog/social media scripts
Inodes
Each plan has a specific inode limit. Exceeding this limit will require an upgrade to the next plan. Abusive inode usage causing disruptions will result in account suspension.
Unmetered Bandwidth
Bandwidth usage is unmetered under our fair usage policy. Abusive usage will lead to account suspension or termination without refunds.
Disk Space Usage
Disk space is for website-related files only. Using disk space for backups or file sharing is prohibited.
Reselling Non-Reseller Plans
Shared hosting accounts cannot be resold. Violators will face termination without refunds.
Suspended Account Storage
Reseller accounts with suspended sub-accounts for over 90 days will be terminated. Backup storage is not allowed.
Dedicated IP Address Policy
Dedicated IPs are non-transferable and require proper justification as per ARIN policies. Dropals may deny IP requests without proper justification.
Uptime Guarantee
We guarantee 99.9% uptime over a 12-month period. This excludes issues beyond our control, such as ISP failures or natural disasters. Service credits can be requested for uptime concerns.
Server Location
Data center locations are subject to availability. Dropals may relocate accounts as needed.
Daily Backups
we retain backups for 30 days. Our nightly backups cover all Shared, Business, and WordPress hosting plans, but these backups are intended solely for our administrative use and are not guaranteed. It is the customer’s responsibility to maintain their own backups on personal computers. Dropals is not liable for any lost or incomplete data resulting from backup failures, even if such failures are due to our negligence. We strive for accurate backups but make no guarantees about their availability. Always back up your site to your personal computer.
We use JetBackup exclusively for our primary backup system and do not rely on the default cPanel backup system for account backups. You can manually generate a backup of your entire account at any time via JetBackup. If you require us to create a manual cPanel backup, please note that a fee will apply. For precise pricing, consult our Billing department before making such a request.
Please note that hosting accounts are not to be used as backup solutions. Our services are designed solely for hosting websites and should not serve as data repositories. Dropals reserves the right to remove backups from hosting accounts with or without notice.
We may also delete files that use excessive disk space and impact other customers, including: (i) local cPanel or other backups, (ii) local Softaculous backups, (iii) Softaculous backup temp files, (iv) local Common CMS backups, (v) Common CMS backup temp files, (vi) Common CMS backup logs, (vii) large error logs, and (viii) any other large files deemed unnecessary for website functionality or not containing valuable data. cPanel-generated backups stored on the server will be automatically deleted after fourteen (14) days.
Ownership of Website
The legal owner is the individual or organization listed in our database. Customers must comply with our security measures in case of ownership disputes.
Illegal Use
Dropals servers must be used lawfully. Storing or distributing illegal material will result in immediate termination without refunds.
Copyright Violations
Customers must comply with the DMCA. Proper notifications of copyright infringement are required. Accounts may be terminated for DMCA violations.
Child Pornography
Storing or distributing child pornography is prohibited and will be reported to law enforcement.
Indemnification
Customers agree to indemnify Dropals against any liabilities or claims arising from their use of our services.
Disclaimer
Dropals services are provided “as is” without warranties. We do not guarantee error-free, secure, or uninterrupted service. We are not liable for any damages arising from the use of our services.
Limitation of Liability
Dropals’ liability is limited to the amount paid for services during the 3 months before any damage or loss occurred.
Modifications
Dropals may modify its services at any time. Customers are responsible for managing personalized applications and content.
Independent Contractors
Dropals and its customers are independent contractors. Neither party can create obligations on behalf of the other.
Construction and Interpretation
The TOS will be interpreted broadly. Headings are for convenience only and do not affect interpretation.
Complete Agreement and Exclusivity
The TOS is the complete agreement between Dropals and its customers, superseding all other agreements.
Refusal of Service
Dropals reserves the right to refuse, cancel, or suspend service at its discretion. All sub-networks must adhere to the TOS.
Third Party Providers
Some services may be provided by third parties and subject to additional terms.
Abuse Towards Staff
Abusive behavior towards staff is not tolerated. Offenders may face suspension or termination.
Billing Policy
Payments
we will notify you at least seven (7) days before your renewal pricing is due for monthly, annual, or longer-term plans. Unless stated otherwise, your payment method on file will be charged as follows:
- On the payment due date.
- If the initial payment attempt fails, we will retry charging on the due date.
- If the second payment attempt also fails, we will make another attempt three (3) days after the due date.
You agree and authorize us to automatically charge the applicable fee to your credit card or other payment methods on file for each Renewal Term, provided you do not cancel or terminate the Services before the charge is made. All fees are billed in United States Dollars (USD) and are subject to change with prior notice.
Dropals can only automatically collect payments from customers who have credit cards stored on file. Payments via other methods, such as one-time PayPal transactions, must be initiated manually by you. It is your responsibility to ensure that all fees are paid by their due date.
As a Dropals customer, you are responsible for maintaining accurate billing information and ensuring that any credit card or other payment method on file has sufficient funds for processing. You are liable for any fees imposed by your issuer, bank, or financial institution, including membership, overdraft, insufficient funds, and over-the-limit fees. Dropals screens all orders for fraud; if your account is flagged, your order may not be processed. Dropals is not liable for any failure to provide Services, including third-party services, if your account does not pass the fraud check.
Grace Period
Accounts 7 days past due are suspended. Accounts 15 days past due are terminated, and all related files are deleted.
Account Credit
Credit balances can only be used for Dropals services and are non-refundable.
Upgrading/Downgrading
Accounts can be upgraded or downgraded at any time, but promotional codes may be lost during downgrades.
Overpayments
Overpayments are added to account credit and are non-refundable.
Account Renewals
Plans automatically renew at the end of the billing cycle. To cancel, submit a request before renewal.
Statements
Invoices and statements are sent via email. Customers must ensure a valid email address is provided.
Cancellations
To cancel your an active service with us, please submit a cancellation request via the client area. Our Billing department will review and process your request promptly after confirmation.
For security and accuracy, we require all cancellation requests to be submitted through the cancellation form in your client area. This ensures we can verify your identity and confirm that you understand your files and emails will be permanently deleted upon cancellation. This procedure helps prevent errors and fraudulent requests while ensuring you’re aware of the immediate and permanent removal of your data.
To cancel your hosting service, please complete the cancellation request form. This helps us understand your reason for leaving and ensures a smooth cancellation process. The form will ask you to:
Describe the Reason for Cancellation: Provide the reason for your decision to cancel the service.
Choose the Cancellation Type: Select one of the following options:
Immediate Cancellation: Your service will be terminated automatically when our system updates at 2 AM Eastern Standard Time (EST), which is 7 AM GMT. If you submit your request before 2 AM EST, the cancellation will take effect on the same day at 2 AM EST (7 AM GMT). If submitted after 2 AM EST, the service will end the following day at 2 AM EST (7 AM GMT).
End of Billing Period Cancellation: Your service will remain active until the end of your current billing cycle, and will then cancel automatically on the due date of the payment period.
After you submit the form with all required details, our Billing team will handle your request according to the selected cancellation type. You will receive confirmation once the cancellation is finalized.
30-Day Money-Back Guarantee
All hosting plans except VPS and dedicated server plans carry a 30-day money-back guarantee. VPS plans have a 7-day money-back guarantee, and dedicated server plans have a 24-hour money-back guarantee. Some services are excluded. Refunds are issued in the original payment method.
Refund Policy
Refunds are available only under the money-back guarantee. No refunds are given after the guarantee period.
Credit Card Disputes/Chargebacks
Chargebacks incur a $50 fee. Accounts may be suspended or terminated.
Billing/Price Changes
Prices are subject to change without notice. Changes take effect in the next billing cycle.
Affiliate Program
Affiliates must not use spam to generate sales. Violators will have their accounts terminated, and funds forfeited. Payouts are made after 60 days if the account is active, with a minimum payout threshold of $300.
Dropals reserves the right to update the TOS without notice. No warranties are implied or given.
